1. Introduction

Welcome to KEST, a financial technology platform operated by MGBL Technologies ("Company," "we," "our," or "us"). By downloading, accessing, or using the KEST application, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our services.

2. Nature of Services

KEST acts solely as a digital technology service provider. We facilitate the transfer of funds from valid, user-owned credit cards to designated recipient bank accounts for legitimate purposes such as rent, education, business vendor payments, and utility bills. We are not a bank, NBFC, or a licensed payment aggregator. All financial routing and processing are handled by RBI-licensed partner gateways (e.g., Razorpay, Cashfree).

3. Fees, Taxes, and Settlement

• Convenience Fees: Using a credit card to transfer funds incurs a platform convenience fee and applicable government taxes (such as 18% GST). This complete breakdown is transparently displayed on the "Review Transfer" screen prior to authorization.
• Settlement Timelines: Depending on the payment method and destination bank, funds are routed via IMPS/NEFT. While we strive for instant settlement, transfers are subject to standard banking delays and may take up to T+2 (Transaction Day + 2 Business Days) to reflect in the recipient's account.

4. User Responsibilities and Compliance

To maintain the integrity of our platform and comply with Indian financial regulations, you agree to the following:

• You will only use credit cards that are legally issued to you.
• You will not use KEST to facilitate cash advances to your own bank accounts, money laundering, or any illegal activities.
• You must provide accurate KYC (Know Your Customer) information if requested by MGBL Technologies or our payment partners.

MGBL Technologies reserves the right to suspend or permanently ban accounts exhibiting suspicious, fraudulent, or non-compliant behavior without prior notice.

5. Refunds, Cancellations, and Chargebacks

Because transfers are initiated immediately upon 3D Secure (OTP) authorization, transactions processed via KEST are strictly non-refundable and cannot be cancelled once captured.

In the event of a technical failure where your card is charged but funds are not dispatched to the recipient bank, the amount will be automatically refunded to your source card within 5-7 business days. Users initiating fraudulent chargebacks with their credit card issuers after a successful bank payout will face legal action and immediate platform termination.

6. Limitation of Liability

MGBL Technologies shall not be held liable for any indirect, incidental, or consequential damages resulting from the use of our platform, including but not limited to bank server downtime, delayed settlements by payment gateways, or errors made by the user when entering recipient account numbers or IFSC codes.

7. Modifications to Terms

We reserve the right to modify these Terms & Conditions at any time. Continued use of the platform after such changes are published constitutes your acceptance of the new terms.
